All work that Speech Power agrees to undertake is subject to the following terms and conditions.

Definitions

  • “We”, “Us” and “Our” means Speech Power, which includes, writers, editors, trainers and speakers.
  • “You” and “Your” means the individual or organisation purchasing the services who is of legal age.
  • “The Services” means work performed by Speech Power including speech writing, creating presentations, slide deck design, keynote speaking and training workshops.
  • “Work” is a term used interchangeably with “The Services”.
  • “Project” means the work and services you engage Speech Power to complete.

 Acceptance of Terms and Conditions
You are held to have read and understood these Terms and Conditions once you provide written acceptance of our quotation for your project.

 Project Quote
Speech Power will include firm prices, project descriptions, timeframes, revision provisions and payment terms in our written quotations, provided full information is supplied by you.

 Speech and Presentation Styles
Speech Power uses accepted and documented practices in creating speeches and presentations, and providing speaking and training services.

 Delivery Deadline
Speech Power will use best endeavours to deliver your project to the agreed deadline. If, however, we are unable to do so due to reasons beyond our control, we shall not be liable for any loss or damage caused to you or a third-party client.

 Client Satisfaction
Speech Power uses proven and widely accepted writing practices backed by extensive experience. Our aim is to supply you with superior services that meet your deadlines and project specifications. Should you cancel or reject our work, after having clearly communicated and collaborated on any revisions, the following fees apply:

  • 80% of quoted price after the first draft
  • 90% of the quoted price after the second draft
  • 100% of the quoted price after the third draft.

 Cancellation
Should you choose to cancel or reject the project within 7 business days of any draft being delivered to you, an invoice will be submitted at this time. Should you cancel or reject the project more than 7 business days after the delivery of any draft, you will be liable for the full quoted fee.

 Project Delays
An important part of deadline delivery by Speech Power is the time it takes for you to provide feedback, additional required information or approval. We shall not be held liable for any delay that is a direct result of your ability to respond to any supplied draft within 30 days after delivery of that draft to you. Where project delays are due to your lack of appropriate response, Speech Power reserves the right to invoice you the full quoted amount. We also retain absolute discretion to invoice you pro rata for the amount of work completed.

 Payment Terms
All payments must be made within 7 days from the date of invoicing, unless otherwise noted on the invoice.   Unless otherwise agreed, invoices will be issued upon your acceptance of the final draft of the project. This applies to businesses with an ABN. For social speeches for individuals (including weddings, eulogies and birthdays) prepayment for services is required, unless otherwise agreed before the service is delivered.

Speech Power reserves the right to submit to collection agencies any payments that are overdue by 60 days or more.  In the event of the account being in default and being referred to an external party for collection, the customer shall be liable for all resulting costs arising from the recovery, including commissions charged by collection agencies which would be payable if the account is paid in full and legal costs including legal demand costs.

If collection or legal efforts to collect outstanding payments are not successful, we retain the right to re-use, sell, distribute and publish any completed work for which payment is owing. We also reserve the right to report late and delinquent accounts to credit agencies at our discretion, which can affect the credit rating of you and/or your business.

 Indemnity
Except as expressly provided by law, Speech Power will in no event be liable for any indirect, consequential, exemplary, incidental or punitive damages resulting from any of our services.

 Confidentiality

Speech Power and you both agree not to disclose any confidential information obtained about the other’s business or personal details. Text that is written and edited by us and is not confidential (such as keynote speeches made to public audiences) may be used and published as samples and for teaching purposes. Identifying details (such personal stories and details that would identify the speaker) will be changed to fictitious ones in samples to maintain client privacy.

Updates
Speech Power may at its discretion amend, update or modify these Terms and Conditions as it sees fit. You agree to remain bound at all times by these Terms and Conditions as amended, updated or modified in connection with your use of the Services.

 Governing Law
These Terms and Conditions shall be interpreted and enforced in accordance with the laws of the State of Victoria, Australia. The venue for any litigation arising from disputes brought by the customer or Speech Power shall be in the State of Victoria.
